Attorneys fight exonerated Ohio captain's release

LONDON, Ohio (AP) -- Prosecutors are fighting to stop a former Ohio police captain from being released from prison after a judge exonerated him in his ex-wife's murder.

Summit County Court of Common Pleas Judge Judy Hunter said in a Tuesday ruling that new DNA test results prove former Akron police captain Doug Prade's innocence. She ordered him released immediately.

Prosecutors asked Hunter to stop Prade from being released until their appeal works its way through the court system, but she turned them down. Now the prosecutors are appealing that decision to the Ninth District Court of Appeals in Akron.

It's unclear how soon a ruling might come.

Margo Prade, a prominent 41-year-old Akron doctor, was found shot dead in her minivan outside her office on Nov. 26, 1997.
